A FEDERATED ISRAEL-PALESTINE

This is the plan of prof. Alfred de Grazia for a federation of Israel and Palestine. I don't agree with all the details, but the large picture and rationales of the project are OK for me.

Israel and Palestine are my subject. What a chaos!

At this moment of history, the Government of the United States of America is less esteemed by the world than at any time since its Declaration of Independence of 1776. As if to confirm the worst tendencies of the Bush Presidency, the Congress, both Senate and House, as this month of May, 2002 began, voted overwhelmingly for resolutions that praised the cruel behavior of Israel and lashed out against the impotent Palestine authority.

The elite of the World's Superpower is badly confused . The American leadership in both major parties is actively promoting ethnic cleansing of the Palestinians while telling them to desist from all armed resistance to their invaders. Like the Israeli leaders, the American leaders claim to see a decisive moral difference between a bomb exploded by hand in a restaurant and a bomb dropped from the sky on a restaurant.

There are two contrasting opinions about the situation in Israel-Palestine:

The first and, unfortunately, dominating opinion holds these views:

1. It is impossible for Jews and Palestinians to live as neighbors

2. Equal justice and opportunities for all people is anyhow an absurd ideal.

3. Israel can end all violence against itself by ruthless force.

4. Every other proposed solution is well- known and is impossible or disastrous.

5. The U.S.A. must back the Israeli government at all costs.

6. Israel is intended by God to be ruler of Palestine.

It is supremely important that you do not accept this position, which is a formula for self-destruction.

The contrasting opinion, which I endorse, can be stated as follows:

1. The situation in Palestine-Israel is a continuing disaster, with no solution in sight.

2. 4 million Palestinians have been rendered helpless, homeless, destitute, and hopeless unless the outside world intervenes.

3. Israel has become a Garrison State (less and less democratic and more and more militaristic), and most Israelis are adversely affected by this trend and deeply disturbed.

4. The USA has been in charge of this situation for 55 years and bungled, meanwhile losing friends all over the world and provoking war and crisis.

5. Gentiles and Jews of the Western World should unite on a just and determined strategy.

We hold to this second position. And on the basis of this position, we have framed our model of a Federal Government. Let us be clear: We are creating here a utopia, but any considerable plan for a better society is a utopia. And our utopia is feasible under certain conditions.

To be adopted, our plan has to be brought forcibly to the attention of the top leaders of the countries involved: the USA, Israel, Palestine, NATO, the European Union, the Arab League, Russia, and the United Nations. If the plan were known and understood by these leaders, the probability of its being adopted would jump to 20%. Its chances at the moment may be 1%.

In the first quarter of this year the plan has been distributed around the offices of the United Nations and in an Earth Summit meeting in New York to governmental and non-governmental delegates. It has received praise wherever it has been read. Still this is not at all true access to the top leaders of the 30 or so countries that are or might be feeling an involvement in the Near East crisis. Although the United States government has called a summit meeting for the coming summer; it has not said what it wants to do, except to do something. So, as matters stand, our Federation plan hasn't a chance in a hundred of adoption.

Perhaps no useful plan whatsoever can penetrate the cloud of madness that envelops Israel-Palestine.

But all the other plans and all the other proposals for peace that have come to my attention amount only to procrastination, games of terror and war, an interminable slow bleeding of 8 million people, an obstacle that bars us from addressing properly many serious world problems of population, ecology, health, employment and education, civil war, terrorism, racism, invidious discrimination, and human rights. These are the costs already of a preoccupation with the Israel-Palestine maelstrom.

These costs of neglecting the world of the Middle East, and indeed the whole world, must be added to the special monetary expenditures that have gone into handling the situation in the Near East, actually, I should say, mishandling the situation. Such extra costs have been estimated, for the USA alone, at about 350 billion euros, starting back in 1945 and carrying up to the present time. And Congress has just promised Israel more aid.

Never mind the prospects of an armageddon. Even if the situation does not worsen, the chances that this agony and mass mischief will continue on their course are almost certain.

But let me now advance my principal argument today. I argue that the best solution to the terrible conflict between Jews and Arabs in Palestine is a radical seizure of authority over the region by a coalition of powerful concerned nations and international organizations, and the imposition upon Israel and Palestine of a Federal Government over a single territory.

A nation is proposed whose Palestinian citizens will be able to contribute heavily to the modernization of the many Islamic nations of the world, and whose Israeli citizens can assume a leading role in bringing about a world union, with justice, peace and welfare for all.

My plan contains a newly drafted Constitution for the Federation of Israel-Palestine. Like other complete Constitutions, the Constitution that I am offering is a declaration of who is authorized, to decide, and do, what, for whom, when, and with what guiding rules.

I should remind you that neither Israel nor Palestine has a proper constitution.

Israel has not been able to draft for itself a constitution, because of hostilities between secularists and fundamentalists. It has been developing a body of basic legislation. But now it has become a Garrison State, a state dominated by military elements and restricting individual rights.

Palestine has no deliberate constitution. It is a Dystrocracy, that is, a disordered political aggregate.

My Constitution proposes a Federation, a federal state of two states, Israel and Palestine. The Israel-Palestine Federation is to cover the full area now occupied by Israel and Palestine. Within this united area, however, the two states are in the beginning culturally separate -- Jewish and Arab. This implies, of course, that there will be religious and ethnic differences between the two States. But they will operate over the whole territory with respect to their own constituent citizens. They govern their Arab and Jewish citizens in important ways, but important limitations are imposed upon them by the Constitution, and the Federal government has several important powers. They are autonomous states; their powers can hardly be taken away from them without their consent. They are ethnic states, for their power to establish a state religion has been taken away.

I shall now try to give you the whole scheme in a single sentence. It is, of course, going to be a very long sentence. Here it is:

To rescue the Israeli People from a Garrison State, and the Palestinians from a Victimized Impotent Authority, we would transform both systems into a federated, full democracy, in which the Palestinian refugees have returned, to a single territory encompassing all of Israel and Palestine, whose Federation will consist of a State of Israel and a State of Palestine, each State having equal claim to the full land and nation of Israel-Palestine, each governing its own freely-joined citizens, in respect to certain basic functions of law, liberty, and welfare, each State electing its own Council of State from single-member, equally-populous districts using the approval- voting system, with both States mutually counseling, reconciling, and determining matters, by means of a Conference Committee of the two Councils of State, an Advisory Senate, a Supreme Court, a United Nations Temporary Peacekeeping Federal Commission that fades into its indigenous replacement, the Federal Commission, with armed forces that are operated at first by the State of Israel, and police forces that are operated at first by the State of Palestine, and possessing a central bank and common currency, and guaranteeing to every inhabitant a decent minimum subsistence, plus a federal, adequate mental and physical health delivery system for all, plus a universal education system for children and adults, plus the freedom to come and go from Israel-Palestine, plus the right to own and use personal and business properties, plus the right to belong freely to any accepting religion or belief.

Such is the vision of the Federation of Israel-Palestine, FIP.

For such a radical plan to succeed, it must overcome seven challenges:

1. It must be championed by the USA, the Arab League, Turkey, Russia, and the European Union -- which altogether implies UN support. This coalition must be prepared to deliver an ultimatum to the Israel and Palestine governments to accept the plan or else have their countries forcibly sanctioned until they acquiesce.

The American government alone could handle this job. But how can the American government be brought to its senses? This must happen, but how can it happen?

Three things can make it happen. One is the re-education of the 10,000 top leaders of the country, and perforce therefore the several hundred top leaders. Some need only reminders of history, some need counter-pressures, some need brainwashing. But it is difficult to gain access to their minds. Media controls, political contributions, skilled counsel and management aides, mythology of history and the Bible - see to it that American leaders can turn a blind eye to the situation in Palestine.

Three per cent of all Americans are Jews and about half of all American Jews would like U.S. Near East policies to change so as to be fair and just and helpful to the Palestinians. But neither these Jews, nor their gentile counterparts, carry great weight when it comes to putting pressures, both subtle and harsh, on politicians and community leaders.

These weighty pressures come for the most part from organizations and well-placed individuals who practice or favor orthodox Judaism and from their hard-nosed professional staffs. The informed and active political and voting behavior of the ordinary Jew, so unlike most gentiles in these regards, tends to back up pro-Israel policies or, what is very important, keep the society from expressing anti-Israel policies. Jewish organizations are careful to tie the Nazi Holocaust to the fortunes of Israel, and most ordinary Americans have come to believe that Israel is the well-deserved patrimony of the Jews for having suffered the Shoah or Holocaust. And they are led to believe that the Palestinians were in the beginning as scarce as Indians are in the State of Indiana.

A united front by the European Union and the European members of NATO, favoring the methods of the Constitution for the Federation of Israel-Palestine proposed here, would affect the American position strongly, especially if the discordance could be brought home to the ordinary American citizen, or even just to the intelligentsia of America. The Israel government realizes this and is trying to divide Europe from America and to make friends with Russia.

A third reason why the American government might change its policies is terrorism. The terrors being visited upon the Jews of Israel by Arab bombers and gunners are causing many people to change their political positions. The so-called "war against terror" is expensive and may not be decisively won. Thereupon the western world will carry a continual burden of fear. Under certain conditions, terror can be effective, like it or not.

If the Israel government and its mighty armed forces cannot wipe out Palestinian violence by their own immeasurably greater violence, the game is lost for Israel.

The Jewish people cannot withstand terror without end. It does not matter that the Israel military machine is wrecking Arab Palestine and murdering civilians. Israelis will still be terrorized and unable to carry on worthwhile lives. The government will have to make peace on terms that are increasingly favorable to the Palestinians.

The horrors of the present situation conceivably might release the American government from its constraints, as more and more American Jews and gentiles are consternated. Already, on top of the universal Islamic indignation, there has been a growing anti-Israel feeling in many European and South American countries. No matter how hard we may seek to contain this sentiment, it is bound to increase the level of anti-semitism in various countries. So, the U.S.A. government may have to bite the bullet and finally act justly and firmly in Israel and Palestine.

On only one occasion has Israel felt the wrath of the United States. That was when Israel, France, and Great Britain attacked to seize the Suez Canal from Egypt. All three nations, confronted by President Eisenhower's quick, stiff rejection, withdrew their forces and their plan.

2. The Plan must bring back the Palestinian refugees and their descendants to their homeland. Fifty-five years of humiliation, deprivations, and an alien despotism, have descended on some ten million Palestinians over two generations.

Is this comparable to the Holocaust that brought suffering and death to five million Jews? Some Palestinians have spoken of their persecution as their own holocaust or shoah. One thing is certain - comparisons of this kind are difficult and controversial, but both involve an immense widespread suffering that the world should attend to, and that would include especially the USA.

Re-settling two million Palestinians or more presents no grave problem. It would cost an insignificant fraction of the money that has been spent until now on armaments and destructive conflict. Israel has taken in over the past few years a million Russians who have some claim to a Jewish heritage. Very well: with a much expanded territory, in collaboration with the Palestinian part of the Federation, and with American and European help, it can take in two millions Palestinians within the same period of time or less. I have designed a housing and settlement scheme that can handle such numbers of people well and at a low cost. It is a challenge that a million talented and frustrated Jews of the world, never mind their Palestinian counterparts, would be delighted to take up.

3. The Plan must solve the problem of territorial boundaries and of who can live where.

For half a century, and for a century even before then, Jews and Arabs have struggled over property boundaries, dragging many countries into the conflict. They play a nasty game of chess, now snatching a piece here, now there, now claiming one piece then another, drawing all sorts of maps, scheming and dreaming about all kinds of seizures and purchases and boundary lines, blowing up each other to win a foothold.

This surrealist tragicomedy would largely end, if all the territory were consolidated into one piece, and the people in it could settle wherever they would find a place.

A strategy here could be to first announce the boundaries of the two States as they were originally set up by the United Nations, and then, because there would be howls of protest from both Israelis and Palestinians, to convert the two territories quickly into a single territory, much to their satisfaction.

4. The rescue plan must resolve the problem of religious fundamentalism, and, in so doing, the problem of the status of Jerusalem.

Like most large cities of the world, Jerusalem is composed mainly of urban sprawl. Its boundaries are crazy and have no necessary connection with the Jerusalem of the ancient Hebrews, or with any other tribe and nation who have ruled the place. The one thing we can be sure of is that there are a hundred thousand or so Jews and Arabs who will readily kill their neighbors as proof of their claim to any one of a number of holy places in Jerusalem.

The many attempts to decide the boundaries of the city and assign pieces to the parties concerned are ultimately nonsensical. There is no city and there should be no city. There is a cultural center, with many holy places and archaeological digs. Let Jerusalem's sprawl be divided into a number of electoral and administrative districts that are integrated into the larger map of Israel.

Let all Israel-Palestine, the whole Federation, be a single metropolis. It is, after all, smaller in numbers than Greater London, the Metropolitan Region of New York, Mexico City and other urbanized regions. Its area is greater than these places and permits a full measure of truck farming. Highly relevant is the promised ability to travel in all directions, so different from the present cramped quarters of everybody.

Let the religious cults have their sacred places; but where they conflict, let the Federal Government step in and run the site with a commission made up of the disputing cults.

5. Our plan must also give Israel a workable, representative, election system, and the same to Palestine. You would think that Jews would be able to govern themselves so well as to design an enviable election system. Not at all. Their election system is an invitation to anarchy and the Garrison State. What the two peoples need is the so-called "Favored Candidate Voting System" working from single-member districts, whereby the voter gives a vote to any and all candidates for office whom he would accept. The candidate who gets the largest total of favorable votes wins. With this method, a party system consisting of liberal and conservative, or conservative and radical, political tendencies should be able to work well.

6. The Constitution must afford every Palestinian and Israeli full human rights and place the Federation under the jurisdiction of the World Court. This would be part of the advancing trend to world government and not an injury to Israeli-Palestinian pride. It would stop the persecution of Palestinians by Israelis and eventually vice versa.

7. The plan must provide for its own transition into real life. That is, we must provide the means by which the present situation can be transformed into a radical controlled reconstruction. This I have done in the Constitution. If the two authorities of Israel and Palestine do not agree to submit to this just demand, a Commission selected by the United Nations and the Coalition of Nations must take charge of the whole country. Then they must carry out the steps called for by the Constitution. In such a case, within several years, the Commission could turn over its offices and powers to the constitutionally elected representatives of the Israelis and Palestinians.

These, then, are seven challenges to the Plan, with the methods that I would propose for dealing with them.

So now I must leave you with a distressing picture of the present, and a menacing prospect of the future. I leave you, also, with a constructive Federal Democracy of Israel and Palestine -- a plan that will probably be torn to pieces with other good things.

Jerome M. Segal: The Sovereignty Belongs to God Option

To whom belongs the Temple Mount/Haram al-Sharif, who has sovereignty over it?

The idea of placing the Temple Mount / Haram al-Sharif under the sovereignty of God to resolve the dispute was first expressed by the late King Hussein of Jordan. Then, it made an interesting appearance at Camp David in summer 2000, before the failure of the entire Oslo peace process: Ehud Barak offered a compromise in the form of "handing over sovereignty of the site to God".
A good article from the Palestine-Israel Journal describes those events.

But is it possible for sovereign states to use divine sovereignty to resolve their conflict? Can they limit the sovereignty of God to a small place? Would not they, by this, being showing how they consider themselves superior to God?

In my opinion, the "sovereignty belongs to God" principle should extend to the entire Israel/Palestine land, under federal administration. Both states of Israel and Palestine should be conceived of truly devoid of any sovereignty, and seen as mere independant administrators of goods that do not belong to them.
Let us consider all the advantages of the God's sovereignty solution discribed in these articles by Jerome Segal and apply them to the entire conflict.

On the Temple Mount, God is the Key

Israel is prepared to formalize the status quo on the Temple Mount, where day-to-day administration is in Muslim hands. The problem is that from an Israeli perspective, the status quo includes Israeli sovereignty and Palestinian administration. While Palestinians have never accepted Israel's claim to sovereignty, this issue has remained dormant. But in the context of a Palestinian state, any international treaty covering administrative control will inevitably engage the sovereignty issue.

Who has underlying sovereignty over the plateau itself? To whom does it belong? If this question is always answered in a traditional way - either Israel is sovereign, or Palestine is - then there will be no solution.

An alternative approach is needed, one that formally disposes of the sovereignty issue, making it possible for administrative matters to be purely administrative - important, but not of vital symbolic meaning. A possible solution lies in a suggestion made several years ago by the late King Hussein - that the two sides should stop arguing over sovereignty and agree instead that ultimate sovereignty belongs to God.

What makes this approach so interesting is that it resonates powerfully among Palestinians of all political and religious orientations. When Palestinians were asked what they thought of this approach to the holy sites in Jerusalem, 64 percent indicated their support. Among those who identify with Islamic fundamentalist parties, the figure soared to 77 percent, and among the very religious it was 88 percent.

What these numbers suggest is that in this simple phrasing - sovereignty over Jerusalem's religious sites belongs to God - there is the making of a stable framework, a symbolism to last generations.

The fact that there is an approach to the Temple Mount-Haram al Sharif that has wide support, even among those most resistant to any agreement in other areas, should be translated into political support among Jewish Israelis. Research has shown that the single greatest determining factor in any willingness of Jews to accept a compromise on Jerusalem, is whether a peace agreement will bring genuine and lasting peace. "Sovereignty belongs to God" holds that promise. It is a phrase that will resonate with Muslims throughout the Islamic world, especially in Iran.

Cynics may say, "fine, sovereignty belongs to God - but whose God?" This is exactly the point. Judaism, Islam and Christianity all affirm there is only one God. The Torah presents God as the sovereign of both the children of Isaac and those of Ishmael. In Genesis, God makes a covenant with Hagar that from Ishmael will also come a great nation.

The point is, there is great potential within the religious traditions for reconciliation between both these peoples. A settlement of the Jerusalem question that underlines this ancient belief in a common God - in common ancestors - has a power it would be foolish for negotiators to ignore.

Given the collapse of the Netanyahu government over the Wye peace agreement, it is time once again to question whether the entire peace process begun in Oslo in 1993 is the right instrument for bringing peace between Palestinians and Israelis. It is my view that the peace process has in fact put off the real reconciliation that must occur if the 100-year war between Zionism and the Palestinian people is to end. Oslo set the stage for separation, but real peace can come only with a binational Israeli-Palestinian state.
This is not easy to imagine. The Zionist-Israeli narrative and the Palestinian one are irreconcilable. Israelis say they waged a war of liberation and so achieved independence; Palestinians say their society was destroyed, most of the population evicted. And, in fact this irreconcilability was already quite obvious to several generations of early Zionist leaders and thinkers, as of course it was to all the Palestinians.

"Zionism was not blind to the presence of Arabs in Palestine," writes the distinguished Israeli historian Zeev Sternhell in his recent book, The Founding Myths of Israel. "Even Zionist figures who had never visited the country knew that it was not devoid of inhabitants. At the same time, neither the Zionist movement abroad nor the pioneers who were beginning to settle the country could frame a policy toward the Palestinian national movement. The real reason for this was not a lack of understanding of the problem but a recognition of the insurmountable contradictions between the basic objectives of the two sides. If Zionist intellectuals and leaders ignored the Arab dilemma, it was chiefly because they knew that this problem had no solution within the Zionist way of thinking."

Ben Gurion, for instance, was always clear: "There is no example in history," he said in 1944, "of a people saying we agree to renounce our country, let another people come and settle here and outnumber us." Another Zionist leader, Berl Katznelson, also had no illusions that the opposition between Zionist and Palestinian aims could ever be surmounted. And binationalists like Martin Buber, Judah Magnes, and Hannah Arendt were fully aware of what the clash would be like, if it ever came to fruition, as of course it did.

Vastly outnumbering the Jews, Palestinian Arabs during the period after the 1917 Balfour Declaration and the British Mandate always refused anything that would compromise their dominance. It's unfair to berate the Palestinians retrospectively for not accepting partition in 1947. Until 1948, Zionists held only about seven per cent of the land. Why, the Arabs said when the partition resolution was proposed, should we concede 55 per cent of Palestine to the Jews who were a minority in Palestine? Neither the Balfour Declaration nor the mandate ever specifically conceded that Palestinians had political, as opposed to civil and religious, rights in Palestine. The idea of inequality between Jews and Arabs was therefore built into British, and subsequently Israeli and United States, policy from the start.

The conflict appears intractable because it is a contest over the same land by two peoples who believed they had valid title to it and who hoped that the other side would in time give up or go away. One side won the war, the other lost, but the contest is as alive as ever. We Palestinians ask why a Jew born in Warsaw or New York has the right to settle here (according to Israel's Law of Return) whereas we, the people who lived here for centuries, cannot. After 1967, the issue between us was exacerbated. Years of military occupation have created in the weaker party anger, humiliation, and hostility.

To its discredit, Oslo did little to change the situation. Arafat and his dwindling number of supporters were turned into enforcers of Israeli security, while Palestinians were made to endure the humiliation of dreadful and noncontiguous "homelands" that make up only about nine per cent of the West Bank and 60 per cent of Gaza. Oslo required us to forget and renounce our history of loss, dispossessed by the very people who have taught everyone the importance of not forgetting the past. Thus we are the victims of the victims, the refugees of the refugees.

Israel's raison d'être as a state has always been that there should be a separate country, a refuge, exclusively for Jews. Oslo itself was based on the principle of separation between Jews and others, as Yitzhak Rabin tirelessly repeated. Yet over the past 50 years, especially since Israeli settlements were first implanted on the Occupied Territories in 1967, the lives of Jews have become more and more entwined with those of non-Jews.

The effort to separate has occurred simultaneously and paradoxically with the effort to take more and more land, which in turn has meant that Israel has acquired more and more Palestinians. In Israel proper, Palestinians number about one million, almost 20 per cent of the population. Among Gaza, East Jerusalem, and the West Bank, which is where the settlements are the thickest, there are almost 2.5 million more Palestinians. Israel has built an entire system of "by-passing" roads, designed to go around Palestinian towns and villages, connecting settlements and avoiding Arabs. But so tiny is the land area of historical Palestine, so closely intertwined are Israelis and Palestinians, despite their inequality and antipathy, that clean separation simply won't, can't really occur or work. It is estimated that by 2010 there will be demographic parity. What then?

Clearly, a system of privileging Israeli Jews will satisfy neither those who want an entirely homogenous Jewish state nor those who live there but are not Jewish. For the former, Palestinians are an obstacle to be disposed of somehow; for the latter, being Palestinians in a Jewish polity means forever chafing at inferior status. But Israeli Palestinians don't want to move; they say they are already in their country and refuse any talk of joining a separate Palestinian state, should one come into being. Meanwhile, the impoverishing conditions imposed on Arafat are making it difficult to subdue the highly politicised people of Gaza and the West Bank. These Palestinians have aspirations for self-determination that, contrary to Israeli calculations, show no sign of withering away. It is also evident that as an Arab people -- and, given the despondently cold peace treaties between Israel and Egypt and Israel and Jordan, this fact is important -- Palestinians want at all costs to preserve their Arab identity as part of the surrounding Arab and Islamic world.

For all this, the problem is that Palestinian self-determination in a separate state is unworkable, just as unworkable as the principle of separation between a demographically mixed, irreversibly connected Arab population without sovereignty and a Jewish population with it. The question, I believe, is not how to devise means for persisting in trying to separate them but to see whether it is possible for them to live together as fairly and peacefully as possible.

What exists now is a disheartening, not to say, bloody, impasse. Zionists in and outside Israel will not give up on their wish for a separate Jewish state; Palestinians want the same thing for themselves despite having accepted much less from Oslo. Yet in both instances the idea of a state for "ourselves" simply flies in the face of the facts: short of ethnic cleansing or mass transfer as in 1948 there is no way for Israel to get rid of the Palestinians or for Palestinians to wish Israelis away. Neither side has a viable military option against the other, which, I am sorry to say, is why both opted for a peace that so patently tries to accomplish what war couldn't.

The more that current patterns of Israeli settlement and Palestinian confinement and resistance persist, the less likely it is that there will be real security for either side. It was always patently absurd for Netanyahu's obsession with security to be couched only in terms of Palestinian compliance with his demands. On the one hand, he and Ariel Sharon crowded Palestinians more and more with their shrill urgings to the settlers to grab what they could. On the other hand, Netanyahu expected such methods to bludgeon Palestinians into accepting everything Israel did, with no reciprocal Israeli measures.

Arafat, backed by Washington, is daily more repressive. Improbably citing the 1936 British Emergency Defence Regulations against Palestinians, he has recently decreed, for example, that it is a crime to incite not only violence, racial or religious strife but also to criticise the peace process. There is no Palestinian constitution or basic law. Arafat simply refuses to accept limitations on his power in light of American and Israeli support for him. Who actually thinks all this can bring Israel security and permanent Palestinian submission?

Violence, hatred, and intolerance are bred out of injustice, poverty, and a thwarted sense of political fulfillment. Last fall, hundreds of acres of Palestinian land were expropriated by the Israeli army from the village of Umm Al-Fahm, which isn't in the West Bank but inside Israel. This drove home the fact that, even as Israeli citizens, Palestinians are treated as inferior, as basically a sort of underclass existing in a condition of apartheid.

At the same time, because Israel does not have a constitution either, and because the ultra-Orthodox parties are acquiring more and more political power, there are Israeli Jewish groups and individuals who have begun to organise around the notion of a full secular democracy for all Israeli citizens. The charismatic Azmi Bishara, an Arab member of the Knesset, has also been speaking about enlarging the concept of citizenship as a way of getting beyond ethnic and religious criteria that now make Israel in effect an undemocratic state for 20 per cent of its population.

In the West Bank, Jerusalem, and Gaza, the situation is deeply unstable and exploitative. Protected by the army, Israeli settlers (almost 350,000 of them) live as extraterritorial, privileged people with rights that resident Palestinians do not have. (For example, West Bankers cannot go to Jerusalem, and in 70 per cent of the territory are still subject to Israeli military law, with their land available for confiscation). Israel controls Palestinian water resources and security, as well as exits and entrances. Even the new Gaza Airport is under Israeli security control. One doesn't need to be an expert to see that this is a prescription for extending, not limiting, conflict. Here the truth must be faced, not avoided or denied.

There are Israeli Jews today who speak candidly about "post-Zionism", insofar as, after 50 years of Israeli history, classic Zionism has neither provided a solution to the Palestinian presence, nor an exclusively Jewish presence. I see no other way than to begin now to speak about sharing the land that has thrust us together, sharing it in a truly democratic way, with equal rights for each citizen. There can be no reconciliation unless both peoples, two communities of suffering, resolve that their existence is a secular fact, and that it has to be dealt with as such.

This does not mean a diminishing of Jewish life as Jewish life or surrendering Palestinian Arab aspirations and political existence. On the contrary, it means self-determination for both peoples. But that does mean being willing to soften, lessen, and finally give up special status for one people at the expense of the other. The Law of Return for Jews and the right of return for Palestinian refugees have to be considered and trimmed together. Both the notions of Greater Israel as the land of the Jewish people given to them by God and of Palestine as an Arab land that cannot be alienated from the Arab homeland need to be reduced in scale and exclusivity.

Interestingly, the millennia-long history of Palestine provides at least two precedents for thinking in such secular and more modest terms. First, Palestine is and always has been a land of many histories; it is a radical simplification to think of it as principally, or exclusively Jewish or Arab. While the Jewish presence is long-standing, it is by no means the main one. Other tenants have included Canaanites, Moabites, Jebusites, and Philistines in ancient times, and Romans, Ottomans, Byzantines, and Crusaders in the modern ages. Palestine is multicultural, multi-ethnic, multi-religious. There is as little historical justification for homogeneity as there is for notions of national or ethnic and religious purity today.

Second, during the inter-war period, a small but important group of Jewish thinkers (Judah Magnes, Buber, Arendt and others) argued and agitated for a binational state. The logic of Zionism naturally overwhelmed their efforts, but the idea is alive today here and there among Jewish and Arab individuals frustrated with the evident insufficiencies and depredations of the present. The essence of that vision is coexistence and sharing in ways that require an innovative, daring and theoretical willingness to get beyond the arid stalemate of assertion and rejection. Once the initial acknowledgment of the other as an equal is made, I believe the way forward becomes not only possible but attractive.

The initial step, however, is a very difficult one to take. Israeli Jews are insulated from the Palestinian reality; most of them say that it does not really concern them. I remember the first time I drove from Ramallah into Israel: it was like going straight from Bangladesh into southern California. Yet reality is never that near. My generation of Palestinians, still reeling from the shock of losing everything in 1948, find it nearly impossible to accept that their homes and farms were taken over by another people. I see no way of evading the fact that in 1948 one people displaced another, thereby committing a grave injustice. Reading Palestinian and Jewish history together not only gives the tragedy of the Holocaust and of what subsequently happened to the Palestinians their full force but also reveals how, in the course of interrelated Israeli and Palestinian life since 1948, one people, the Palestinians, have borne a disproportional share of the pain and loss.

Religious and right-wing Israelis and their supporters have no problem with such a formulation. Yes, they say, we won, but that's how it should be. This land is the land of Israel not of anyone else. I heard those words from an Israeli soldier guarding a bulldozer that was destroying a West Bank Palestinian field (its owner helplessly watching) in order to expand a by-pass road.

But they are not the only Israelis. For others, who want peace as a result of reconciliation, there is dissatisfaction both with the religious parties' increasing hold on Israeli life and Oslo's unfairness and frustrations. Many such Israelis demonstrate energetically against their government's Palestinian land expropriations and house demolitions. So one senses a healthy willingness to look elsewhere for peace than in land-grabbing and suicide-bombs.

For some Palestinians, because they are the weaker party, the losers, giving up on a full restoration of Arab Palestine is giving up on their own history. Most others, however, especially my children's generation, are sceptical of their elders and look more unconventionally toward the future, beyond conflict and unending loss. Obviously, the establishments in both communities are too tied to present "pragmatic" currents of thought and political formations to venture anything more risky, but a few others (Palestinian and Israeli) have begun to formulate radical alternatives to the status quo. They refuse to accept the limitations of Oslo, what one Israeli scholar has called "peace with Palestinians", while others tell me that the real struggle is over equal rights for Arabs and Jews, not a separate, necessarily dependent and weak, Palestinian entity.

The beginning is to develop something entirely missing from both Israeli and Palestinian realities today: the idea and practice of citizenship, not of ethnic or racial community, as the main vehicle for coexistence. In a modern state, all its members are citizens by virtue of their presence and the sharing of rights and responsibilities. Citizenship therefore entitles an Israeli Jew and a Palestinian Arab to the same privileges and resources. A constitution and a bill of rights thus become necessary for getting beyond square one of the conflict, since each group would have the same right to self-determination; that is, the right to practice communal life in its own (Jewish or Palestinian) way, perhaps in federated cantons, a joint capital in Jerusalem, equal access to land and inalienable secular and juridical rights. Neither side should be held hostage to religious extremists.

Yet, feelings of persecution, suffering and victimhood are so ingrained that it is nearly impossible to undertake political initiatives that hold Jews and Arabs to the same general principles of civil equality while avoiding the pitfalls of us-versus-them. Palestinian intellectuals need to express their case directly to Israelis in public forums, universities, and the media. The challenge is both to and within civil society which long has been subordinate to a nationalism that has developed into an obstacle to reconciliation. Moreover, the degradation of discourse -- symbolised by Arafat and Netanyahu trading charges while Palestinian rights are compromised by exaggerated "security" concerns -- impedes any wider, more generous perspective from emerging.

The alternatives are unpleasantly simple: either the war continues (along with the onerous cost of the current peace process) or a way out , based on peace and equality (as in South Africa after apartheid) is actively sought, despite the many obstacles. Once we grant that Palestinians and Israelis are there to stay, then the decent conclusion has to be the need for peaceful coexistence and genuine reconciliation. Real self-determination. Unfortunately, injustice and belligerence don't diminish by themselves: they have to be attacked by all concerned.

דו-לאומיות בפלסטין-ישראל: בחירה פלסטינית היסטורית - לא בלית ברירה

תהליך השלום` של אוסלו, מסתבר, הביא יותר אלימות מאשר שלום. למעשה, מקושר תהליך זה לעימותים האלימים ביותר בין פלסטינים לישראלים בהסטוריה בת מאה השנים של העימות. הדיבורים הנשמעים לאחרונה על חידוש `תהליך השלום` מבוססים כנראה על אותן הנחות שעליהן התבססו התהליכים הקודמים בשנות ה-90, תוך התעלמות מוחלטת מן הלקחים שנלמדו ממרתון אוסלו. ההסלמה האחרונה של העימות הישראלי-פלסטיני מטילה ספק בקשר לדרך בה ייפתר העימות. עם זאת, ככל שמסלים העימות, גדל גם הצורך בפתרון.

מאז הצעתי לראשונה, בשנת 2001, את `האג`נדה הפלסטינית החלופית` (APA) מוקדשת תשומת לב רבה לרעיון הדו-לאומיות. אג`נדה זו הציעה איחוד פדרלי של פלסטין-ישראל עם בירה משותפת בירושלים. ההצעה זכתה להתענינות רבה באופן כללי ולתמיכה רבה יותר בצד הפלסטיני מאשר בצד הישראלי. היא זכתה, בין היתר, לתמיכתו של ד`ר חיידר עבד-אל-שאפי - אחד האישים הפלסטינים הבולטים, היתה נושא לדיון מפורט בסדנת האסטרטגיה הפלסטינית במדיסון, ויסקונסין בנובמבר 2002, שאליה באו אינטלקטואלים ומנהיגים פלסטינים מפלסטין ומהגולה. היוזמה הוצגה ונדונה בפורומים שונים בקמפוסים ברחבי ארצות הברית, כולל סימפוזיון בכנס של העמותה ללימודי המזרח התיכון (MESA) בשנת 2004 בסן פרנסיסקו. היוזמה הוצגה ונדונה גם בפורומים פלסטינים וישראלים משותפים ונפרדים בירושלים, החברה האקדמית הפלסטינית לנושאים בינ`ל (PASSIA) אירגנה סימפוזיון במכון המחקר ע`ש טרומן באוניברסיטה העברית, ובכנס ארגוני שלום ישראליים בירושלים. עתה, לאחר 4 שנים של דיון, ראוי לבדוק מחדש את רעיון הדו-לאומיות, לדון בכמה מהחששות שהועלו בדיונים הרבים, ולהגיב על כמה מהתפיסות השגויות של הרעיון והשימוש הבלתי הולם שנעשה בו מצד אלה ואחרים.


כשלון `תהליך השלום`

כדי לבחון את הדרכים שבהן ניתן יהיה להשיג פתרון לסכסוך יש להבין קודם כל איך והיכן נכשל `תהליך השלום` של אוסלו. למרות הטענות כי תהליך השלום קרס בגלל שאלת ירושלים, מצביעות העדויות על כך שהתהליך קרס בגלל שאלת זכות השיבה הפלסטינית. לקראת השלבים האחרונים של המו`מ בין הפלסטינים לישראלים, בין 1998 ל- 2000, דנו עשרות קבוצות דיון פלסטיניות בפלסטין, לבנון, סוריה, ירדן, אירופה וצפון אמריקה, בזכות השיבה הפלסטינית. ההתנגדות הפלסטינית ל`תהליך השלום` של אוסלו שהתעלם מזכות השיבה ופנה עורף למעשה אל הפלסטינים הגולים (ולפלסטינים בתוך ישראל), החלה כתגובה ישירה להסכם אוסלו ב- 1993. תנועה זו התחזקה והתפשטה באופן נרחב לאחר יום ציון הנכבה ויום העצמאות ה-50 של מדינת ישראל בשנת 1998. ארוע זה שימש כשעון מעורר לפלסטינים. בפעם הראשונה אירגנו פליטים פלסטינים מסעי שיבה סמליים לאתרי הכפרים ההרוסים. מספר אירועים כאלה נערכו בגדה המערבית ובתוך ישראל, כמו המסע מהכפר קאבול לאתר הכפר ההרוס דאמון. אירועים אחרים כללו פגישות של נוער ממחנות הפליטים בגדר הגבול עם לבנון. צעירים ממחנות הפליטים סאברה ושתילה בלבנון נפגשו עם צעירים מהמחנות עאידה ודהיישה שליד בית לחם. כנסים גדולים על זכות השיבה נערכו. כנס אל-פראח בפלסטין, ואחרים בירדן, לבנון, בריטניה וארה`ב, כולם בשנת 1998, שנת ה-50 לנכבה. למעשה, התרכזה עיקר הפעילות הפלסטינית בנושא זכות השיבה.

תנועה זו ארגנה אירועים נוספים ועוררה ויכוח ער בקרב פלסטינים ברחבי העולם על זכות השיבה. במהלך השנתיים לקראת לשלב הסופי של המו`מ בקמפ דייויד בקיץ 2000, הפעילה דינמיקה זו לחץ על המנהיגות הפלסטינית. לחץ זה מנע מן המנהיגות כל אפשרות לחתום על הסכם שאינו לא לוקח בחשבון את זכות השיבה. הכרת אש`ף בישראל והסכמה להקמת מדינה פלסטינית בגדה המערבית ובעזה ע`י ישראל, טמנה בחובה הבנה מרומזת כי אש`ף מוותר על זכות השיבה. עם התקדמות התהליך הבינו המנהיגים הפלסטינים כי לא יוכלו להסכים לסיום העימות מבלי לטפל בזכויות הפליטים הפלסטינים - צעד כזה יביא לדה-לגיטימציה שלהם. מצד שני, אי אפשר היה לדון בזכות השיבה בשלב מאוחר כל כך של המשא ומתן. לכן היה נוח יותר למנהיגות הפלסטינית להציג את ירושלים כסיבה להתמוטטות התהליך. ראשית, הצגת בעית ירושלים כסיבת כשלון המו`מ מכסה את העובדה שמלכתחילה התעלם התהליך מזכויות הפליטים ומזכות השיבה באופן כללי. שנית, ירושלים כסיבת כשלון התהליך ולא זכות השיבה מביאה למנהיגות הפלסטינית יותר אהדה ממשטרים ערביים.

ההיבט המאיים ביותר של תהליך אוסלו, ככל הנוגע לפלסטינים, הוא שהתהליך מנסה לנתק באופן סופי את הפלסטינים מאדמתם ההיסטורית שעכשיו היא חלק מישראל, ושאליה הם קשורים מבחינה תרבותית בדרכים רבות. יתר על כן, תהליך זה משלים עם חלוקה טריטוריאלית רבה עוד יותר ולאינקפסולציה של קהילות פלסטיניות באיזורים גיאוגרפיים נפרדים בתוך הגדה המערבית. עבור הפלסטינים אין פלסטין אוסף של נכסים אבודים אלא החזון של איחוד הזהות הפלסטינית עם האדמה ועם ההסטוריה של העם הפלסטיני. זהו מרחב שבו נטמעים מנהגים תרבותיים וחברתיים, ושהזהות הפלסטינית מושרשת בו עמוקות. מומחים לנוף מסכימים כי מקום מהווה צורה בסיסית של נסיון מוכל בחיי אנוש. זהו המקום שבו מתרחש איחוד העצמי, המקום והזמן. הקשר של הפלסטינים למולדתם כדבר שלם ושורשיות מתמשכת בה הם האלמנט הבסיסי של בניית הזהות הפלסטינית. לפיכך, אם יימשך תהליך השלום כמו הסכם אוסלו, תוך התמקדות בהפרדה והתעלמות מזכות השיבה, ימשיך התהליך לייצר יותר אלימות מאשר שלום.

למרות שהפרדה בין קבוצות הנתונות בעימותים אלימים נראית כפתרון פרגמטי והגיוני - נכשל נסיון זה כאשר הוא קשור למקור העימות - קרי, התחרות על אותו חבל ארץ. הפלסטינים רואים את הניתוק לא כהפרדה מהישראלים, אלא כהפרדה של הפלסטינים מפלסטין והוצאתם ממנה. לפלסטינים יש תחושה חזקה של שורשיות באדמה, שורשיות שבאה לידי ביטוי בכל ענפי התרבות והאמנות הפלסטינים. יתרה מכך, הניתוק מגביר את תחושת השורשיות, ולא מחלישה, גם בקרב קהילות גולים. נסיונות מתמשכים להגיע להפרדה ולניתוק עוד מגבירים את ההתנגדות כדרך להביע הכחשה וקיום, עקירה ושורשיות.

החסרונות של פתרון שתי המדינות

השיח הנוכחי בעימות הישראלי-פלסטיני כפי שהוא מיוצג בפתרון שתי המדינות מסיט את תשומת הלב מהנושאים העיקריים. בצד הישראלי, הנושא העיקרי של העימות בצד הישראלי היה ונשאר האתגר של בנית מדינה ליהודים בלבד בפלסטין. בצד הפלסטיני לעומתו שרירה וקיימת תפיסת הישראלים כנוכחות קולוניאלית זרה בפלסטין. תוצאת ההתנגשות בין שתי תפיסות מנוגדות אלו היא מעגלים של מלחמה ואלימות מהווים איום רציני לבטחון שני העמים המעורבים בעימות. התפיסה של מדינה ליהודים בלבד מצריכה ומייצרת אמצעי אפלייה כנגד התושבים הלא-יהודים של המדינה, הפלסטינים. לעומת זאת מצריכה התפיסה המתמשכת של הישראלים כנוכחות קולוניאלית זרה - תוכניות לאומיות המיועדות להוציא את הישראלים מפלסטין.

השיח הנוכחי מתמקד בנסיונות להקים שתי מדינות נפרדות שיחיו דו-קיום בין ישראלים לפלסטינים, אך ממשיך להכשל משום שהוא עוקף ונמנע מדיון בנושאים העיקריים ובסתירה שביניהם. לדעתי תיכשל תוכנית שתי המדינות העצמאיות הנפרדות משום שהיא מתבססת על הנחות שקריות. המצדדים בה מניחים כי הרעיון של הוצאת הפלסטינים ממה שעכשיו הוא ישראל עבר נורמליזציה וכעת הוא מקובל על הפלסטינים וכן כי הפלסטינים ושאר ערביי האזור השלימו עם עובדת הנוכחות הישראלית ועם הזכויות הקולקטיביות של הישראלים לביטוי תרבותי בישראל. המציאות בשטח היא ההיפך הגמור. מרבית הפלסטינים לא ויתרו על זכותם על פלסטין ההיסטורית למרות שרוב הפלסטינים בגדה המערבית ובעזה עשויים לתמוך במדינה פלסטינית באזורים אלה. תמיכה כזו לא בהכרח מצביעה על ויתור על קשר תרבותי והיסטורי למה שעשוי להשאר כישראל, ולזכותם לרכוש וזכויות פוליטיות שם. גם העולם הערבי ככלל לא השלים עם נוכחותה של ישראל באיזור. דיון כזה כלל לא החל כלל, וככל הנראה יהיה קשה להתחיל בו כאשר העימות ממשיך ומתגבר. תנועה לעבר פיוס לפני מציאת פתרון תהיה בלי ספק משימה קשה להשגה.

החיוניות של אופציית שתי המדינות מוטלת בספק בשל סיבות רבות אחרות. ראשית, הסידורים לשתי מדינות נפרדות עשויים להוות מתכון למלחמה מתמשכת שכן המדינה הפלסטינית החדשה תהיה מוקפת ע`י ישראל ותמשיך להיות מטרה לאיום מצד הצבא הישראלי החזק יותר. שנית, ההתעלמות מתביעותיהם הכלכליות, החברתיות והתרבותיות של מליוני פלסטינים שיאכלסו את מדינת פלסטין והמופנות לעבר מדינת ישראל. חשוב גם לציין כי הפלסטינים בגדה המערבית ובעזה מייצגים רק שליש מהאוכלוסיה הפלסטינית. סבלם שלהם יגיע לקיצו עם סיום הכיבוש הצבאי, אך סיום הכיבוש הצבאי בגדה המערבית ובעזה איננו סיום העימות. מצוקת הגולה הפלסטינית, המשבר הדמוגרפי בעזה וזכויות הפלסטינים בישראל לא יגיעו לכלל דיון. יתרה מכך, פתרון שתי המדינות אינו מתחשב בזכותם של הפלסטינים שלא להיות מוצאים ממולדתם ההיסטורית במה שיישאר ישראל. בקצרה, חולשתו של פתרון שתי המדינות בכך שהוא לא יוכל לענות באופן משביע רצון על זכות השיבה של הפלסטינים ועל כן אני מטיל בספק את יכולתה של אופציה כזו להביא לפתרון לסכסוך.

הצעת ה-APA לדו-לאומיות בפלסטין-ישראל

מה שהצגתי בהצעת האג`נדה הפלסטינית האלטרנטיבית (APA) הוא שבירת המוסכמה הנוכחית הקוראת להקמת מדינה פלסטינית בגדה המערבית ובעזה. מדינה פלסטינית כזו לא תוכל לפתור את הסכסוך. הצעת ה-APA מבוססת על ההנחה שפתרון בר קיימא לסכסוך יהיה חייב להתחשב בהקשר ההיסטורי שלו, לזהות את המציאות הנוכחית ולעסוק בחרדותיהם של הפלסטינים והישראלים כאחד. הצעת ה-APA תוכננה לענות באופן מקיף על החרדות העיקריות של הישראלים ושל הפלסטינים ולהביא לשיוויון ולנרמול היחסים ביניהם.

המציאות הנוכחית מראה כי הישראלים והפלסטינים אינם נפרדים ואינם ניתנים להפרדה. לפיכך הצעתי שתי מדינות המאוחדות פדרלית. המדינות הללו ישקפו את התפוצה הדמוגרפית הנוכחית ואת צפיפות האוכלוסיה בשטח. המדינה הישראלית תכלול איזורים המיושבים כעת בישראלים יהודים. המדינה הפלסטינית תכלול איזורים המאוכלסים בעיקר ע`י פלסטינים כמו גם איזורים דלי אוכלוסין אשר יוכלו לקלוט פלסטינים שבים. ירושלים, מזרח ומערב, יחד עם פרברי העיר והעיר בית לחם, תהיה אזור שיפוט נפרד שאינו תלוי באף אחת משתי המדינות, ותהווה את מחוז הבירה של האיחוד הפדרלי. לכל מדינה יהיה הפרלמנט שלה, ממשלה, מערכת משפט, כח משטרה, מערכת חינוך שפה, דגל וחגים לאומיים. למחוז ירושלים תהיה מועצה מחוזית המייצגת את תושבי המחוז, והמנהלת את ענייני המחוז וכח משטרה משלו. לאיחוד הפדרלי יהיה מינהל מבצע שיתאם היבטים בעלי עניין משותף לשתי המדינות כמו בטחון חוץ בעזרת צבא מאוחד ובטחון פנים ע`י תיאום בין מערכות הבטחון של כל מדינה, יחסים אתנו-לאומיים בין שתי המדינות חלוקה הוגנת של המשאבים.

מטרת ההצעה היא לענות לשאיפות הלאומיות של הפלסטינים והישראלים ביחס לזהות ולביטוי תרבותי ע`י מתן אפשרות לקיום שתי מדינות. האיחוד הפדרלי יאפשר לשתיהן להישאר יחד במקום שהם קוראים לו בית, ויאפשר לשני העמים גישה לכל שטחי מולדתם, כך שיוכלו לבטא את שורשיהם ההסטוריים. לפלסטינים תהיה זכות לחזור ולבסס את חייהם בערים הסטוריות כמו עכו, חיפה ויפו, בהתאם להליכים מסויימים. בתהליך הבניה ומו`מ בנושאי הסכסוך בין הפלסטינים לישראלים ויצירת מדיומים חדשים לתיווך בין הכללה לשורשיות, יוולדו תחזיות חדשות ליחסים בין ישראלים לפלסטינים במקום החדש של ישראל-פלסטין. מו`מ יכול לשאת פרי רק אם הוא מבוסס על ההכרה בזכותו של האחר. העברת התיווך מצורתו האלימה לצורה התרבותית הלא-אלימה היא בעצם הפתרון. טרנספורמציה כזו מהווה את הערבויות הביטחוניות האמיתיות שעליהן יכולים שני העמים לסמוך באמת.

השגות עיקריות בקשר לדו-לאומיות

ב) ההבדלים הכלכליים בין פלסטינים לישראלים ימשיכו לדחוק את הפלסטינים לשוליים וישאירו אותם פגיעים לשליטה מדינית וניצול כלכלי מצד הכלכלה הישראלית החזקה יותר.

מלבד התפישות השגויות של תוכנית הדו-לאומיות, ישנם מספר שימושים בלתי הולמים ברעיון מצד חברים פלסטינים וישראלים, במיוחד אלה העסוקים במו`מ של התהליך הנוכחי.

היתרונות של התוכנית הדו לאומית מצויים בתנאים שבהם הפלסטינים מוצאים עצמם לאחר יותר מ-55 שנים של נישול וכיבוש של אדמתם. המקרה של הפלסטינים הוא ייחודי ושונה ממקרים אחרים של קולוניאליזם, ולפיכך דורש בחינה מחודשת של תוכנית השחרור הלאומי. ישראל כקולוניה אינה נתמכת ע`י מטרופולין מסורתי כמו במקרה של צרפת באלג`יריה או בריטניה בהודו. היא נתמכת ע`י מטרופולין אבסטרקטי לא-טריטוריאלי, שהוא העם היהודי. תנאים אלה יצרו זהות חדשה, ישראלית - מקושרת ושורשית מבחינה טריטוריאלית לאדמה, לא למטרופולין. מצב זה מציב אתגר חדש בפני התוכנית הלאומית הפלסטינית. איך יכולים הפלסטינים להיות מחוייבים לזכויות הלאומיות הפלסטיניות, אך בו בזמן להשאר מחוייבים לצדק מוסרי? מחוייבויות אלה דורשות מהפלסטינים הלאומיים לחפש דרכים אחרות לטפל בזכויות הלאומיות של הפלסטינים מבלי לסכן את אלה של הישראלים הצברים.

לאומיות אינה יישות אחת. לאומיות יכולה להיות כלי התיישבותי, כמו במקרה של הציונות, או כלי משחרר. בכדי להבטיח שתישאר כלי משחרר, צריכה תפיסת הלאומיות הפלסטינית להיות מבוססת על שחרור פלסטין משליטה קולוניאלית, ולא בהכרח שחרור מישראלים. תוכניות כאלה דורשות מהפלסטינים לשלב במצעים הלאומיים שלהם דרכים להכיל גם זכויות אינדיבידואליות וקולקטיביות לישראלים וזכויות לאומיות עבור הזהות הישראלית החדשה בפלסטין. דרך כזו והקשר היסטורי עושים את התוכנית הדו לאומית לנכונה ביותר לזכויות הפלסטינים והישראלים וכתוכנית מתקדמת לשחרור פלסטין, המבוססת על צדק מוסרי. התוכנית פותרת את שאלת הזכויות הלאומיות של הפלסטינים ועם זאת אינה מתעלמת מהאחריות החברתית והמוסרית כלפי הזהות הישראלית החולקת את אותו השטח עם הפלסטינים.

מפת הדרכים לדו-לאומיות

כאשר נבין מהי הדו לאומיות ומה הם הגורמים העושים אותה לאופציה בת קיימא ויעילה לפתרון הסכסוך, צריכים הפלסטינים והישראלים לעסוק בדיון ודו שיח על פיתוח מפת דרכים לקראת השגתה. בהתחשב בכמות האנרגיה שנוצרה מסביב לתוכנית שתי המדינות, טוב יהיה להתבסס עליה לקראת דו-לאומיות. זה דורש מאיתנו להמשיג את הדו לאומיות ככיוון ולא כמרשם. אפשרות שתי המדינות יכולה להיות שלב בדרך לדו לאומיות. אורן יפתחאל כתב לקראת `דו לאומיות בשלבים` וסעיד זידאני במחנה הפלסטיני דיבר בזכות גישה כזו.

העלאה מחדש של אופציית שתי המדינות יכולה להתפרש כמתן תמיכה לפתרון `שתי המדינות`, אך לא לראות בה את הפתרון הסופי לסכסוך. אסטרטגיה זו גם תשפיע על הדרך שבה מיושמת תוכנית שתי המדינות - שמירת הקשר של הפלסטינים עם ערביי ישראל וחילופי תרבות וכלכלה בין ישראלים לפלסטינים. לאופציית שתי המדינות יש סיכוי להצליח רק כשלב לקראת פתרון מקיף יותר כמו דו לאומיות. אם אפשרות שתי המדינות מוצגת כ`מצב תמידי` סופי, לא יהיה לה אפילו סיכוי להתממש, כל שכן להיות סופית או תמידית. לפיכך, יש בה טעם רק אם שואפים אליה כצעד אינטגרלי לקראת גישה מקיפה לסכסוך הישראלי-פלסטיני שתביא לפתרון לבעיית הפליטים ואיחוד של הזהות הלאומית הפלסטינית. בדינמיקה הפוליטית העכשווית חשוב לתמוך באפשרות שתי המדינות כצעד לקראת דו לאומיות פלסטינית ישראלית בפלסטין-ישראל. דו לאומיות היא בחירה פלסטינית היסטורית ברורה, לא בחירה בלית ברירה. גם עבור הישראלים.

לאחר שראש הממשלה טען ש"הזמן פועל לטובתנו ", וכי האזהרות מפני האיום הדמוגרפי הן מוגזמות, שר האוצר מסביר כי לישראל דווקא יש בעיה דמוגרפית - אולם "זו אינה ממוקדת בשטחים, אלא בערביי ישראל". מנהיגים הציבור הערבי הגיבו בזעם על הדברים , והאשימו את נתניהו בגזענות.

בכנס הרצליה של המרכז הבינתחומי היום (ד') הפתיע השר, בנימין נתניהו, כשהתייחס לראשונה זה זמן רב לנושאים מדיניים, לאחר שניסה בעקביות לחמוק מהם.

נתניהו מתח ביקורת על דבריו של השר אולמרט אתמול בכינוס, לפיהם יש צורך בהיפרדות חד-צדדית גורפת, בין היתר, בגלל "הפצצה הדמוגרפית המתקתקת". נתניהו אמר: "נכון. יש לנו בעיה דמוגרפית. אבל היא לא ממוקדת בערבים הפלסטינים בשטחים, אלא בערביי ישראל".

שר האוצר הסביר כי ישראל השתחררה מכל האוכלוסייה הפלסטינית, וכי למעשה, בכל הסדר עתידי ישראל אינה מתכוונת להמשיך ולשלוט בפלסטינים. "אינני רואה הסדר שבמסגרתו מישהו שפוי ירצה להחזיק בפלסטינים כאזרחי ישראל. בכל מקרה, הם ינהלו את חייהם בעצמם. איש לא מתכוון להישאר בג'נין ובטול כרם, ואין לנו שום כוונה לשלוט באוכלוסייה הפלסטינית. לכן, הבעיה הדמוגרפית לא קיימת שם. אם היא קיימת, זה בקרב ערביי ישראל".

נתניהו קרא לגבש מדיניות שתבטיח את הרוב היהודי במדינת ישראל: "אם המטרה היא מדינה יהודית דמוקרטית, חייבים להבטיח רוב יהודי. ישנה שאלת יחסנו עם המיעוט הערבי. שילוב המיעוט הערבי בחברה הוא גם שאלה מספרית. אם זה יגיע ל-40 אחוז, התבטלה המדינה היהודית. אם יהיו 20 אחוז והיחסים יהיו קשים, תגרניים ואלימים, אזי יש צורך במדיניות שתבטיח את הרוב היהודי במדינת ישראל".

נתניהו רמז לכך שאיננו תומך נלהב ברעיונות של צעדים חד-צדדיים, אך השאיר את דבריו עמומים: "להסכם צריך פרטנר. כל צעד שאתה עושה, צריך לקבל עבורו תמורה. ויתור צריך לבוא עבור משהו". עם זאת, לדברי גורמים בליכוד, בשיחות סגורות הביע נתניהו נכונות להסכים בתנאים מסויימים לצעדים חד-צדדיים מן הסוג שראש הממשלה מכוון אליהם.

"אופנה של תוכניות מדיניות"

שלום: "לא להתפתות לבזאר המדיני"

שר החוץ סילבן שלום הצטרף לדבריו של נתניהו בעניין ההתנגדות לצעדים חד-צדדיים אשר נובעת מהם משמעות פוליטית, לא רק משום שארצות-הברית ורוב הקהילה הבינלאומית נגדם.

השר שלום הזהיר מ"המקסם החד-צדדי", כהגדרתו. לדבריו, "המהלכים מהווים פרס לטרור, מחלישים את היכולת לנהל משא ומתן להסדר בעתיד, ולא יובילו לכל תחושה של מחוייבות מהפלסטינים".

שלום תקף במרומז את יוזמת ז'נווה ואת דבריו של השר אולמרט בעניין הנסיגה החד-צדדית: "הניסיון לנפק פתרונות פלא האפילו על הראייה לטווח רחוק. הספין הופך לחזות הכל. על רקע זה היינו עדים בשנה האחרונה לריבוי תכניות ויוזמות, כשממציאיהן נשבים כקוסם המציע שיקוי פלא לחיי נצח. הלהיט האחרון הוא המקסם החד צדדי".
לדברי שלום, "התכניות השונות שהוצגו לנו עד היום מעידות על אי עמידה, על ייאוש, על ריפיון ידיים, על חוסר סבלנות והיעדר כל התמדה. הן משחקות לידי יריבינו המפרשים תכניות אלה כחולשה שלנו, וכתוצאה מכך, יריבינו אף נמנעים מלמהר ולגשת לשולחן המשא ומתן".

שלום הדגיש את החשיבות האסטרטגית של היחסים בין ישראל לארצות-הברית ואמר כי יש לדבוק בתוכנית "מפת הדרכים", ו"לא להתפתות ליוזמות המדינית ולבזאר המוזר של תוכניות השלום המוצגות".

בראיון ל"ניו-יורק טיימס" אמר שר החוץ כי אם ייכשלו המאמצים בערוץ הפלסטיני, צריך להשלים את בניית הגדר ולפנות לערוץ הסורי, כדי לנסות למצותו. "אסור לשכוח שידנו מושטת לשלום", אמר.

הפלסטינית, אולם תוך 25 שנים צפויים הפלסטינים לסגור את הפער. הסוד טמון כנראה בקצב הילודה: בישראל הוא עומד על 2.9 ילדים בממוצע למשפחה, ואילו ברשות הפלסטינית על 5.7.

בשנת 2050 תתפוס הודו את מקומה של סין כמדינה בעלת האוכלוסיה הגדולה בעולם, עם 1.6 מיליארד תושבים. עוד מתריע הדו"ח, כי רבות מהמדינות המתועשות בעולם עלולות לעבור הידלדלות באוכלוסיה, בעקבות ירידה בשיעור הילודה, משברים כלכליים, ועלייה בשיעור ההגירה שתעכב את הצמיחה.

כמו כן עולה כי בעוד שאוכלוסיית העולם תגדל בכ-50 אחוז עד לאמצע המאה ל-9.3 מיליארד בני אדם, יפן תאבד 20 אחוז מאוכלוסייתה, וגם ברוסיה, גרמניה ואיטליה תחול ירידה במספר התושבים.

אוכלוסיית ארה"ב צפויה לגדול ב-43 אחוז, מ-293 מיליון איש ל-420 מיליון, עד 2050. הצמיחה העיקרית באוכלוסיה העולמית תתרחש בעיקר במדינות המתפתחות באפריקה ובדרום אסיה, למרות מחלת האיידס המתפשטת ושיעור תמותת התינוקות, הגבוה בהרבה ממדינות המערב. בעוד שבמדינות המפותחות יעלה מספר התושבים ב-4 אחוזים, ל-1.2 מיליארד איש, במדינות המתפתחות תחול עלייה של כ-55 אחוז, לכ-5 מיליארד.

סין, בה חיים כיום 1.3 מיליארד בני אדם, תעבור הפחתה של 10 אחוזים באוכלוסיה, ובשנת 2050 יגיע מספר התושבים שלה רק ל-1.4 מיליארד. ב-46 השנים הבאות צפויה גם האוכלוסיה בניגריה לשלש את עצמה ולהגיע ל-307 מיליון בני אדם, ואילו אוכלוסיית בנגלדש תכפיל את עצמה ותגיע ל-280 מיליון.

מחבר הדו"ח, קרל הוב, אמר כי יפן וניגריה הן דוגמה לשתי מדינות עם מגמות הפוכות. לדבריו, בעוד שביפן 19 אחוז מהתושבים כיום הם בני למעלה מ-65, בניגריה רק 3 אחוזים מהאוכלוסיה הם בני למעלה מ-65. "בניגריה יש מיליוני צעירים שזקוקים לחינוך ותעסוקה, ויש צורך בהשקעה כלכלית כדי לספק להם איכות חיים גבוהה יותר, בעוד שיפן צריכה לספק טיפול ביותר ויותר קשישים, ועדיין לשמור על איכות כוח העבודה", הסביר הוב.

על פי הדו"ח, אירופה מודעת לבעיה המתקרבת, ומדינות רבות החלו בניסיונות לחפש עובדים ולהגדיל את שוק העבודה, ובמקביל לסגור את הדלתות בפני מהגרים.

"שיטת המועצות" של חנה ארנדט

סיכום
אינני יודע אם צדקה ארנדט כשהציעה, זמן קצר לפני הקמת המדינה, שפדרציה של מועצות היא הדרך היחידה להציל את המולדת היהודית מציפורניה המאיימות של מדינת הלאום היהודית. בפרספקטיבה של חמישים שנה שעברו מאז, ברור שהסכסוך הישראלי-פלסטיני מלובה על ידי רעיונות לאומיים עזים, ציוניים ופלסטינים כאחד, וקשה לדמיין פדרציה משמעותית בין יהודים לערבים.
אולם אפשר גם לראות בסכסוך העקוב מדם סוג של הזדמנות היסטורית. במדינת ישראל, בעידן שבין האינתיפאדה השניה לשלישית מודעים הציבור הישראלי והפלסטיני כאחד, שמדינת-לאום במודל הקלאסי לעולם לא תתקיים כאן. יתכן שדווקא בשל המבוי הסתום המתמשך בסכסוך לא תהייה לציבור הישראלי כל ברירה אלא לחפש את הפתרון במקום אחר. אני מבקש ללמוד משיטת המועצות של ארנדט שהמלחמה במדינת הלאום ובזוועות והעיוותים שהיא מחוללת במציאות לא חייבת להתממש, לא במהפכה אנרכיסטית כוללת, לא בכינונה של מדינת לאום פלשתינית ואפילו לא בכינונה של מדינת-כל-אזרחיה. המאבק במדינת הלאום יכול לשאת אופי של התאגדות וולנטרית, מלמטה, ושל חיבורים חופשיים בין אינדיבידואלים, בין יהודים וערבים, וגם בין ערבים לבין עצמם ואפילו, עד כמה שקשה לדמיין זאת, בין יהודים לבין עצמם.
